Profectus Align Terms of Service
Effective October 7, 2026.
These terms are an agreement between you and Profectus Application Solutions LLC (“we”, “us”, “our”) about your use of Profectus Align (“Align”). By creating an account, you accept them. Our Privacy Policy and Refund Policy are part of these terms.
1. Align is for adult educators.
- You must be at least 18. Students may not create accounts.
- Each email address can hold 1 account, and you must verify it before you can use Align. Keep your password private. You are responsible for what happens under your account.
- An account belongs to the person who created it. Signing up with a school email address does not make your district a party to these terms. Districts that buy Align for their teachers sign a separate agreement.
2. Your curriculum and your work in Align are yours.
- Your work in every output is yours: the workbook, the rubrics and the coverage map. Standards text belongs to its publisher. Standards Align provides, such as the Common Core State Standards, are used under their publishers’ licences, and their notices travel with your outputs.
- We claim no rights in your curriculum.
- You give us permission to process your uploads, to send them to the providers listed in our Privacy Policy, and to keep the workbooks in your library, only as needed to run Align for you and to gather de-identified data. That data covers the relationship between assessments and standards, and we use it to improve the Profectus family of products, as described in the Privacy Policy.
- If you join the Machine Learning Lab, you also give us permission to use the workbooks in your library to improve Align and our other products, under the Lab terms you agree to on your account screen. Nothing of yours is ever shown to another teacher.
3. You are responsible for what you upload.
- Upload only material you have the right to use. If you upload a publisher’s curriculum, your agreement with that publisher governs whether you may.
- Remove each student’s name and any other identifying details from student work before you upload it.
- Do not upload anything unlawful or harmful, including malware.
4. Align proposes and you decide.
Align uses a language model to draft rubric levels, to read standards documents and to propose which standards an assessment covers. Nothing it proposes goes into an output until you have seen it. Reviewing and accepting each proposal is your responsibility. A rubric in your output is a rubric you accepted. When Align reads a standards document, it copies each standard’s words from your document, and you confirm the list before anything is built. Align will not draft a level that quotes your material. Align runs no code or macros from an uploaded file, and it refuses macro-enabled files. It tells the model to treat text inside your documents as reference material and to ignore instructions written there.
5. A coverage map counts assessments. It never grades anyone.
A coverage map shows how many times each standard you uploaded is assessed: 0, 1, or 2 or more. It is never a pass or a fail of a student, a teacher or a course. Align is not designed or validated as a tool for evaluating people.
6. Align keeps your workbooks only in a library.
Align does not keep your uploads, and it keeps your workbooks only if your account has a library. Download every workbook you want to keep. If you share a program file, you share what it holds, including Align’s earlier wording for any level you rewrote. A workbook in a library stays until you delete it, or until 30 days after your account stops having storage. We cannot recover a file after it is deleted, and we are not responsible for files you did not download.
7. Credits and subscriptions are paid in advance.
- Prices are listed on our pricing page, plus applicable sales tax. Checkout shows the total before you pay.
- New accounts receive free credits, once per email address. Payment is by card, card wallet or Stripe’s Link.
- A credit is spent only when Align hands you a usable draft or proposal. If a draft or proposal fails, comes back unusable, or is never collected, no credit is spent. Reading a standards document with Align is free. Redrafting a rubric is free a set number of times, shown on the pricing page, and redoing anything else Align writes costs a credit.
- Credits do not expire, and you may not sell or transfer them.
- The annual library subscription renews automatically each year at the current price until you cancel. We email you a reminder before each renewal, in the window New York law requires. You can cancel online at any time in the billing portal, and cancelling stops the next renewal.
- All sales are final. Credits and subscription payments are not refundable, as set out in our Refund Policy.
8. Use Align fairly.
You may not:
- access another person’s account or data;
- probe, scan or test Align’s security without our written permission;
- copy, scrape or resell Align, or reach it with automated tools outside the features we provide;
- reverse engineer Align, except where the law allows it;
- interfere with Align’s operation or with other users.
We may delete an account that breaks these terms.
9. We work to keep Align available and cannot promise it always will be.
Align may be unavailable at times for maintenance, updates or problems outside our control. Align also limits its own monthly spending on the language model. When that limit is reached, drafting and reading pause until the 1st of the next month, and a refused request costs you nothing. We may change, add or remove features. We will give notice before a change that removes something you paid for, and if you have not yet used it, we refund the unused part to your original payment method.
10. Align’s drafts come without a warranty.
Align is provided “as is” and “as available.” Rubric descriptors, alignments and standards proposals are drafted by a language model and may contain errors. We do not warrant that any output is accurate, complete, or consistent with how any standard is officially interpreted. You review and accept every proposal (Section 4). To the extent the law allows, we disclaim all other warranties, including merchantability and fitness for a particular purpose.
11. Our liability is limited.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for files you did not download. Our total liability for any claim is limited to what you paid us in the 12 months before the claim. Some states do not allow these limits, so they may not apply to you.
12. You or we can end your account.
You can stop using Align at any time, and delete your account from your account screen. Deleting an account cancels any subscription and forfeits unused credits. What we keep afterward is set out in the Privacy Policy. We may delete an account that breaks these terms or belongs to someone under 18.
13. We will tell you before these terms change.
We email account holders 30 days before a material change takes effect. Using Align after the effective date means you accept the change.
14. New York law governs these terms.
These terms are governed by the laws of the State of New York. Disputes go to the state or federal courts located in Monroe County, New York.
